Full Terms & Conditions of Equipment Hire

  •  “Client” shall mean the party with whom Brendon Orchards Cooperative enters into the “Agreement”
  • The “agreement” shall mean the agreement made between Brendon Orchards Cooperative and the client included in this Equipment Hire Agreement document
  • The “equipment” shall mean the object or objects that are being hired
  • The “whole hire period” shall mean the date dispatched/collected from Brendon Orchards Cooperative until the date returned/delivered to Brendon Orchards Cooperative

All transport costs (delivery and return), including transport insurance, shall be paid by the Client unless specified otherwise in this agreement.

The Client is responsible for loss and damage to the equipment whilst in transport as well as during the loan period.

It is important to remember you are transporting equipment used for food production so you are expected to remove (where possible), or cover anything that could be considered a contaminant – such as pet hair or mud.

One day Hire is 24 hours. The period of Hire shall commence and cease on the dates specified in the invoice.

The client will be responsible for the equipment from the date of dispatch until it is returned to Brendon Orchards Cooperative.

The equipment shall be returned to Brendon Orchards Cooperative on the date specified in the invoice.

Prior to return, the equipment must be:

    1. Cleaned thoroughly according to the instructions provided – a cleaning charge of £20 will be retained from the deposit where a kit is not returned in clean useable condition.
    2. Checked to ensure all items supplied are returned.

If the client does not return the equipment to Brendon Orchards Cooperative within 24 hours of the specified ‘Date To’ in the invoice and has not requested an extension of the loan period as defined in section 6, THIS AGREEMENT SHALL CONSTITUTE A BINDING ORDER TO HIRE THE EQUIPMENT AT THE STIPULATED UNIT COST for each day, or part thereof, that the equipment is not returned. The Client shall accept and pay any invoice issued by Brendon Orchards Cooperative reflecting such hire without the necessity of further documentation being exchanged between the parties.

Should the client wish to extend the period of the hire of the equipment from Brendon Orchards Cooperative then such extension may incur extra costs. Please contact our Apple Press Manager to discuss Hire Extensions; this must be done before the specified ‘Date to’ in the invoice. N.B. It may not always be possible to extend the loan.

The equipment should not be altered in any way without prior written agreement from Brendon Orchards Cooperative; the client may be liable for the full replacement cost(s) of the equipment without this written permission. UNAUTHORISED ALTERATION OF THE EQUIPMENT IS STRICTLY PROHIBITED.

The client is responsible for any cost(s) as a result of loss or damage to the equipment during the whole hire period. These costs shall not exceed the Unit Cost(s) of the equipment.

A copy of the equipment instructions is provided online for you to read and apply. We strongly advise that all operators of the equipment read the equipment instructions in full before use. ON MAKING PAYMENT FOR YOUR EQUIPMENT HIRE YOU AGREE TO TAKE ON THE RESPONSIBILITY FOR CARRYING OUT THE RELEVANT RISK ASSESSMENT(S) AND FOR THE SAFE USE OF THE EQUIPMENT.   • The information you have provided is to enable the administering of your membership and its benefits. The information is for the sole use of Brendon Orchards committee, staff and the Apple Press Manager contractor, it will not be passed to other external agencies.
  • Your data will be password protected and stored securely.
  • Your initial membership fee includes a £1.00 share of BOC. BOC will maintain your contact details until you chose to redeem this share.
  • You have the right to access information we store on you, to have it corrected or have it deleted on request.
  • The chairperson of BOC is responsible for your data and can be contacted by emailing or phoning BOC.
  • You may complain to, or find out more about your rights, from the Information Commissioner’s Office.
